1.1 The sales activity on the websites www.electronic-sud.it and www.electronic-sud.com of the entity hereinafter referred to as Electronic-Sud is carried out as a private and non-professional seller, based in Italy.
1.2 The sale by private subjects of second-hand, hobby, vintage or collectible items is not subject to the rules laid down for those who buy in stores or on the Internet. This does not mean that we believe that those who buy are entitled to a series of protections that we try to provide as similar as possible to Articles from 45 to 67 of Legislative Decree. N. 206 of 6 September 2005 (Italian Law, "Consumer Code") and Legislative Decree. N. 70 of 9 April 2003 relating to ecommerce.
1.3 The sale transaction is considered complete when the customer pays for the order
2.1 The mode of payment is "prepayment" which can be made by postal operations or PayPal
2.2 Coordinates to make the payment shall be communicated by mail after the customer concludes the process of sending of their data (usually the mail arrives in a few of hour)
2.3 Payment must be made within 5 days since the order was made, during this period Electronic-Sud will keep busy as ordered by the customer, otherwise the order will be canceled
3.1 Shipping costs are charged to the customer and also include packaging costs, it depending on the total weight of the products of the order and the place of destination
3.2 Shipments, unless specifically requested by the customer or special logistics needs, are made by "Express Delivery" (in Italy, in 90% of cases it occurs in 48 hours)
3.3 The shipment of the products of an order takes place as follows by 16:00 of the working day following receipt of the payment
3.4 No responsibility can be attributed to Electronic-Sud in case of delay in delivery by the carrier
3.5 The customer must verify the integrity of the package and the delivery of its seals reporting any anomalies by writing it on the transport document or by contacting Electronic-Sud. Once subscribed to the transport document, the Customer may not make any objection about the quality of what they receive
3.6 You can insure the shipment against damage, the cost of the insurance is paid by the customer and is calculated on the value of the goods of the order. If opening the package the customer finds that the products have been damaged during shipment must report it immediately to Electronic-Sud that will collect the damaged and for their replacement or, if unavailable, to refund the amount paid
3.7 You can request that the purchased products are shipped in Gift Packaging, the service is paid by the customer and if bought every product of the order in its original box will be packaged with gift paper and ribbon before being inserted in packaging for shipping
4.1 All products sold on Electronic-Sud are covered only by the Warranty Service if again available
4.2 Electronic-Sud guarantees only goods for which defects appear after the delivery of the goods, which are not foreseeable and which depend on already existing defects. In case of lack of conformity, the consumer has the right to restore, without charge, the conformity of the goods by repair or replacement (Italian Law Consumer Code). In case Electronic-Sud was not able to return the repaired product, the consumer may request an alternative remedies (replacement, refund, price reduction)
4.3 Products sold as USED or as OFFER, unless it is expressly stated, are not covered by the Warranty Service; there is not also a lack of conformity if, at the time the contract was concluded, the consumer was aware of the defect, could not ignore it with the ordinary diligence, or if the lack of conformity comes from instruction or materials supplied by the consumer. Finally, in case of used goods the responsibility for lack of conformity not declared at the time of conclusion of the contract is limited to a maximum period of 12 months
4.4 For all cases not covered by the Terms of Purchase, we apply the seen and liked clause
5.1 The right of withdrawal does not exist for sales between individuals, whether it is a new or used item. However, there is a "guarantee" regarding "defects that make the asset unsuitable for use or reduce its value".
6.1 The consumer shall have a period of eight days to notify de defect of goods
6.2 The return for "defective goods" is exercised by sending, within the aforementioned period of receipt of the goods, a communication via e-mail to the address info@electronic-sud.com. This communication must contain an explicit declaration of the decision to return defective goods and the codes of the products you intend to return
6.3 The consumer must return the goods subject to reconsideration within fourteen days from the date on which notice of the decision to rescind the contract:
6.4 The right of withdrawal can not also be exercised if the product is not intact, ie:
6.5 Electronic-Sud, verified the integrity of the returned goods, will refund the amount of payments received within fourteen days of receipt of goods using the same means of payment used by the customer for the initial transaction. Electronic-Sud is not obliged to refund the additional costs if the consumer has chosen a type of delivery other than the least expensive type of delivery offered
